1. Acceptance of these terms
By accessing or using higpf.com (the "Site"), operated by HIG Premium Finance LLC ("HIG," "we," "us," or "our"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Informational purpose; no offer to lend
The Site is provided for general informational purposes to licensed insurance agencies and brokers. Nothing on the Site constitutes an offer to lend, a commitment to finance, a rate quote, a rate lock, or an Annual Percentage Rate disclosure. All financing is subject to credit review, underwriting, approval, and the execution of a written premium finance agreement, and is offered only where HIG is licensed or authorized to do business. The actual terms of any financing are set forth solely in that executed agreement.
3. Illustrative figures and the payment estimator
Any rates, tiers, examples, or figures shown on the Site, including results produced by the payment estimator, are illustrative only and are provided to help agencies understand how a financed account is generally structured. They assume level monthly amortization and may not reflect the rate, down payment, fees, minimum-earned premium, or installment schedule that would apply to any particular account. Do not rely on them in making financial decisions.
4. Eligibility and intended audience
HIG finances commercial insurance premiums and, in select states where authorized, premiums for personal, family, or household insurance ("personal lines"). The Site is intended for insurance professionals and is not directed to consumers; all financing, including personal lines financing, is arranged through agencies and brokers appointed with HIG. The rates, tiers, examples, and estimator on the Site describe HIG's commercial program only. Personal lines financing is available only where confirmed by HIG for a given state and is made solely under a separate written premium finance agreement containing the consumer disclosures required by applicable law. By submitting a form, you represent that you are a licensed insurance professional or are acting on behalf of one.
5. Agent tools and access
Certain tools and materials on the Site are intended for agencies appointed with HIG. You agree not to share access to those tools or materials with anyone outside your agency, and not to reproduce or distribute HIG's broker manuals, rate sheets, or program documents without our written permission.
6. Intellectual property
The Site and its contents, including text, design, graphics, logos, and the HIG Premium Finance name and marks, are owned by HIG or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your own business use in evaluating our program; any other use requires our prior written consent. Third-party names, logos, and marks referenced on the Site (including PBS) belong to their respective owners, and their appearance does not imply endorsement or partnership except as expressly stated.
7. Acceptable use
You agree not to use the Site in any way that is unlawful, that interferes with its operation or security, that attempts to gain unauthorized access to any system or data, or that submits false, misleading, or automated (bot) form entries.
8. Third-party services and links
The Site relies on third-party services (for example, form processing) and may link to third-party websites and platforms. HIG does not control and is not responsible for the content, availability, or practices of those third parties.
9. Disclaimer of warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, HIG disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Nothing on the Site constitutes legal, tax, accounting, or insurance advice.
10. Limitation of liability
To the fullest extent permitted by law, HIG and its members, managers, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of business, profits, or data, arising out of or relating to your use of or inability to use the Site, even if advised of the possibility of such damages. In no event will HIG's total liability arising out of the Site exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless HIG from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.
12. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
13. Changes
We may revise these Terms at any time by posting an updated version on the Site with a new "Last updated" date. Your continued use of the Site after a change means you accept the revised Terms.
